About the Law
Prop. 207 passed in November 2020 with more than 60 percent of the vote. Campaign proponents spent more than a year working with diverse coalitions to craft policy that made the best sense for Arizona. From there, they built support around key provisions of the proposition including:
New tax revenue dedicated to public safety, community colleges, roads and public health.
An intentional, limited footprint for the industry so there weren’t “dispensaries on every corner.”
Prohibition of public consumption.
The law also includes:
Recreational Marijuana cannot be sold to or consumed by anyone under the age of 21.
No smoking marijuana in a public place or open space.
No consuming marijuana or marijuana products while driving, operating, or riding in the passenger seat of an operating motor vehicle, boat, vessel, aircraft or another vehicle used for transportation.
Possession limits for recreational marijuana: one ounce, not more than 5 grams of marijuana may be in the form of marijuana concentrate in a single transaction.
6 plants allowed for personal use, 12 plants per household with at least 2 adults over the age of 21. Marijuana grown for personal use can NOT be sold. That is a crime. Those plants are for personal use only.
Packaging and restrictions on specific marijuana products:
Marijuana products must be: (1) sold to consumers in clearly and conspicuously labeled containers that contain accurate warnings regarding the use of marijuana and marijuana products, and (2) placed in child-resistant packaging on exit from a marijuana establishment.
A marijuana establishment may NOT:
Package or label marijuana or marijuana products in a false or misleading manner.
Manufacture or sell marijuana products that resemble the form of a human, animal, insect, fruit, toy or cartoon.
Sell or advertise marijuana or marijuana products with names that resemble or imitate food or drink brands marketed to children, or otherwise advertise marijuana or marijuana products to children.
Edible limits: a marijuana establishment shall limit the strength of edible marijuana to no more than 10mg of THC per serving or 100mg of THC per package.
If a marijuana product contains more than one serving, it must be delineated or scored into standard serving sizes and homogenized to ensure uniform disbursement throughout the marijuana product.
These regulations remain in effect, and explain why popularity has only grown (now at 64%) since adult-use was legalized.
